Please read these Terms of Service carefully before using Oracle. By accessing or using our service, you agree to be bound by these terms.

Oracle is an educational and wellness tool designed to support executive function skills development.
Oracle does NOT:

1. Service Description
1.1 Educational and Wellness Tool
Oracle is an educational and wellness tool designed to help users explore, understand, and develop their executive function skills. Oracle provides educational content, self-reflection tools, and organizational features to support users in building effective daily habits and strategies.
1.2 Not a Medical Device
Oracle is NOT a medical device. Oracle has not been evaluated, cleared, or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory body. Oracle does not diagnose, treat, cure, or prevent any disease or medical condition, including but not limited to Attention Deficit Hyperactivity Disorder (ADHD), autism spectrum disorder, or any other neurological or mental health condition.
1.3 Not a Substitute for Professional Care
Oracle is not intended to replace or substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician, mental health professional, or other qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or experienced through Oracle.
1.4 Emergency Services
Oracle is not designed for emergency or crisis situations. If you are experiencing a medical emergency, mental health crisis, or are in danger, please immediately contact emergency services (911) or a crisis helpline such as the 988 Suicide & Crisis Lifeline.
1.5 AI-Generated Content
Oracle uses artificial intelligence to generate insights, recommendations, and suggestions based on information you provide. You acknowledge and understand that:
- AI-generated content may be inaccurate, incomplete, or not applicable to your specific situation
- AI recommendations are for informational and educational purposes only
- You should independently verify any information provided by Oracle
- You are responsible for evaluating and deciding whether to act on AI-generated suggestions
- AI technology has inherent limitations and may produce unexpected or incorrect results
Oracle's AI features are designed to support your executive function development journey, not to make decisions for you. Always exercise your own judgment and consult qualified professionals when appropriate.
2. Acceptance of Terms
By creating an account, accessing, or using Oracle, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use Oracle.
You must be at least 13 years old to use Oracle. Users under 18 require parental or guardian consent. By using Oracle, you represent that you meet these age requirements.
3. User Responsibilities
3.1 Appropriate Use
You agree to use Oracle only for its intended educational and wellness purposes. You understand that Oracle is a self-help tool and not a replacement for professional treatment. You agree not to use Oracle for diagnosing medical conditions, making treatment decisions, or as an emergency response tool.
3.2 Accuracy of Information
You agree to provide accurate and truthful information when using Oracle. You understand that the insights and recommendations provided by Oracle are based on the information you provide and may not be accurate if you provide false or misleading information.
3.3 Consulting Healthcare Providers
You agree to consult with qualified healthcare professionals for medical advice, diagnosis, or treatment. You understand that Oracle does not provide medical advice and that you should not rely on Oracle for medical decisions.
3.4 Compliance with Laws
You agree to use Oracle in compliance with all applicable laws and regulations. You agree not to use Oracle for any unlawful purpose or in any manner that could damage, disable, overburden, or impair our services.
4. Account Registration and Security
4.1 Account Creation
You must provide accurate, current, and complete information during registration. You agree to update your information as needed to maintain its accuracy.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or use of your account
4.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these terms, at our sole discretion.
5. Subscription and Payment
SUBSCRIPTION AUTO-RENEWAL
Your subscription automatically renews unless you cancel. You can cancel anytime in Account Settings. No refunds for partial months.
5.1 Subscription Tiers
Oracle offers multiple subscription tiers:
- Free Tier: Basic features with limited functionality
- Pro Tier: Full access to all consumer features
- Professional Tier: For licensed healthcare providers (requires BAA)
- Enterprise Tier: Custom pricing for organizations

5.2 Billing
- Subscriptions auto-renew unless cancelled before the renewal date
- By subscribing, you authorize us to charge your payment method on a recurring basis
- Prices are subject to change with 30 days advance notice
- No refunds are provided for partial billing periods
5.3 Free Trial
- New users may be eligible for a free trial period
- Free trials automatically convert to paid subscriptions unless cancelled
- Cancel anytime during your trial with no charge
5.4 Cancellation
- You may cancel your subscription at any time through Account Settings
- Access continues until the end of your current billing period
- No refunds are provided for unused subscription time
6. Intellectual Property
6.1 Oracle's IP
All content, features, functionality, and technology provided through Oracle—including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof—are owned by Oracle and protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Your Content
You retain ownership of content you submit to Oracle (including Voice Dumps, journal entries, task entries, and other user-generated content).
By using Oracle, you grant us a license to:
- Process and analyze your content to provide the Service
- Use de-identified, aggregated data for research and service improvement (with your consent)
- Store and backup your content to ensure service reliability
6.3 Restrictions
You may not:
- Copy, modify, or create derivative works based on Oracle
- Reverse engineer, decompile, or disassemble the software
- Remove any proprietary notices or labels
- Use Oracle's name, logo, or trademarks without written permission
7. Prohibited Uses
You agree NOT to:
- Violate any applicable laws or regulations
- Infringe on others' intellectual property rights
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to Oracle's systems
- Harass, abuse, or harm other users
- Use Oracle for any illegal purpose
- Scrape, data mine, or extract data without permission
- Impersonate any person or entity
- Share your account credentials with others
- Use automated systems to access Oracle (except through approved APIs)
- Interfere with or disrupt the Service or servers
8. Limitation of Liability
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Oracle is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
Oracle makes NO WARRANTIES regarding:
- Accuracy of recommendations or insights
- Medical outcomes or health improvements
- Uninterrupted or error-free service
- Security of data transmission
Oracle shall NOT be liable for:
- Direct, indirect, incidental, or consequential damages
- Personal injury or emotional distress
- Loss of data or profits
- Any damages arising from use of the Service
MAXIMUM LIABILITY: Oracle's total liability shall not exceed the amount you paid to Oracle in the 12 months prior to the claim.
9. Disclaimers and Warranties
9.1 No Medical Warranty
ORACLE MAKES NO WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF RECOMMENDATIONS, INSIGHTS, OR INFORMATION PROVIDED THROUGH THE SERVICE.
9.2 No Warranty of Outcomes
We do not guarantee any specific results, improvements, or outcomes from using Oracle. Individual results may vary based on many factors beyond our control.
9.3 Third-Party Services
Oracle may integrate with third-party services (e.g., calendar applications, productivity tools). We are not responsible for the functionality, availability, or security of third-party services, and your use of such services is governed by their respective terms and policies.
9.4 Service Availability
We do not guarantee uninterrupted access to Oracle. The Service may be unavailable due to scheduled maintenance, updates, technical issues, or circumstances beyond our reasonable control.
10. Indemnification
You agree to indemnify and hold harmless Oracle, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of Oracle
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to Oracle
- Any misrepresentation made by you
11. Data and Privacy
Your use of Oracle is subject to our Privacy Policy, which explains how we collect, use, store, and protect your information.
Professional Tier - HIPAA Protections
For Professional Tier users sharing data with healthcare providers, additional HIPAA protections apply under our Business Associate Agreement (BAA). Contact hipaa@eforacle.com for more information.
12. Termination
12.1 Your Right to Terminate
You may terminate your account at any time through Account Settings or by contacting support.
12.2 Our Right to Terminate
We may suspend or terminate your access to Oracle, without prior notice, if you:
- Violate these Terms of Service
- Engage in fraudulent or illegal activity
- Provide false or misleading information
- Fail to pay applicable subscription fees
- Abuse or harm other users or our systems
12.3 Effect of Termination
Upon termination:
- Your access to Oracle will cease immediately
- Your data may be deleted according to our data retention policy
- You may request data export before termination
- Paid subscription fees are non-refundable
- Provisions that should survive (liability, IP, dispute resolution) will remain in effect
13. Dispute Resolution
DISPUTE RESOLUTION - ARBITRATION AGREEMENT
By using Oracle, you agree to resolve disputes through binding arbitration, not court proceedings. You waive the right to participate in class actions, class arbitrations, or representative proceedings.
Contact legal@eforacle.com to attempt informal resolution before initiating arbitration.
13.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
13.2 Arbitration Agreement
Any disputes arising from these Terms or your use of Oracle shall be resolved through binding arbitration administered by the American Arbitration Association (AAA), except for:
- Claims that qualify for small claims court
- Disputes involving intellectual property rights
- Requests for emergency injunctive relief
13.3 Class Action Waiver
You agree to resolve disputes with Oracle on an individual basis only, and not as part of a class action, collective action, or representative proceeding.
13.4 Informal Resolution
Before filing for arbitration, you agree to contact us at legal@eforacle.com to attempt informal resolution. We will attempt to resolve your concern within 30 days.
14. Professional Tier Additional Terms
The following terms apply specifically to Professional Tier subscribers who are licensed healthcare providers using Oracle in a clinical or therapeutic context.
14.1 Healthcare Provider Requirements
Professional Tier users must:
- Be licensed healthcare professionals in good standing
- Have a valid, executed Business Associate Agreement (BAA) on file with Oracle
- Comply with HIPAA and all applicable state and federal healthcare laws
- Use patient data only for authorized treatment purposes
- Maintain appropriate professional liability insurance
14.2 Patient Consent
Healthcare providers must obtain explicit, informed consent from patients before accessing their Oracle data. Providers are responsible for documenting this consent in accordance with applicable regulations.
14.3 Clinical Judgment
Oracle is a support tool only. Healthcare providers remain solely responsible for all clinical decisions and patient care. Oracle data and insights should be considered as supplementary information only and should not replace clinical judgment, assessment, or standard of care protocols.

15. Changes to Terms
We may modify these Terms of Service at any time. Changes will be effective:
- Immediately for new users upon posting
- 30 days after notice for existing users
Notice of changes will be provided via:
- Email to your registered email address
- In-app notification
- Posting on our website at eforacle.com/terms
Your continued use of Oracle after changes are posted constitutes acceptance of the modified Terms. If you disagree with any changes, you must discontinue use of Oracle and may terminate your account.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy and any applicable Business Associate Agreement, constitute the entire agreement between you and Oracle regarding your use of the Service.
16.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
16.3 No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
16.5 Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, government actions, or failures of third-party services.
16.6 Survival
The following sections shall survive any termination of these Terms: Limitation of Liability, Indemnification, Intellectual Property, Dispute Resolution, and any other provisions that by their nature should survive.
